I still feel the main issue is that the line between fuctionality that can be sold outside the Market and functionality that can't is blurry.
For example, I suppose the ad-free version of Angry Birds will be sold as a separate app. But what if they sold that functionality from their website, and applied it to the app you already have? Would that be okay?
