No. The GPL says "thou shall make any source of any code thou
redistributes available". But since an ASP doesn't really redistribute
anything (and this applies to consultant work as well) the GPL does not
apply. An ASP would legally be able to do pretty much whatever with
jBoss and not have to redistribute anything. This is my understanding of
it at least.

Telkel could, technically, do the same thing. The only thing is that we
have internally agreed that this is a no-no (apart from stuff that would
only be relevant for Telkel as an ASP), and that we would be shooting
ourselves in the familiar foot should we, for example, create clustering
code that is not given back to jBoss the organization.
