Agaar Community Youth Representatives

Subject: Condemnation of Arrest of community elder John Muorwel Majak

APR. 6/2011, SSN; Introduction:

After widespread sad news of arrest of our community elder Mr. John
Muorwel Majak Wol yesterday evening at around 8:15 PM at South Sudan
Hotel in Juba, where he was putting up, it came into public knowledge
immediately and made consultations with various Government
stakeholders and in particular the security organs, his entire
whereabouts was not known until five o’clock on Tuesday April 5, 2011.
The public in general and Agaar community in particular is further
unaware and concern for his safety and when he will be released
following the alleged charges labeled against him by the unknown
accusers.

Our community elder was taken by 10 security personnel in plain
clothes and driven to unknown destination. This is unacceptable and
the entire youth of Agaar community in their mental capacities voice
condemnation at strongest possible term whatsoever. Mr. John Muorwel
Majak came from Khartoum to attend the Agaar Community meeting that
was organized here in Juba. Following this kind of invitation, he came
as a member and an elder of the community but not in his capacity as
army officer of the Sudan Army forces in question.

However, South Sudan is soon going to be an independent nation and
therefore the community has its rights as enshrined in the Interim
Constitution of Southern Sudan to organize itself into lawful assembly
and freedom of expression respectively. This was the general principle
of our meeting to call upon the Agaar community members at all walk of
life and strife for social unity.

The Agaar community has positively made an outstanding contribution
during the liberation struggles in the Sudan since its inception under
the leadership of our revolutionary movement the SPLM/A. As loyal
supporters of the right to self determination for the people of the
South Sudan, we therefore regret the way our elders are mistreated by
the Government that we fought very hard to bring into being using
everything at our disposal both human and material resources to
achieve the freedom and justice to the would-be Republic of South
Sudan due on July 9, 2011. Is this how the Societies can be paid?
Logically, the answer is NO. But if others believe the contrary, then
the youth of Agaar community without any fear whatsoever totally
rejected it and they are ready to reject it now and in future whether
it will happen to Agaar community or any other community member in
South Sudan.

Before we could explain our position statement, the following
questions deserves answers from any level of Government and or those
individuals who might be in a position to satisfactorily answer us
whether why targeting Agaar politicians, intellectuals and or senior
military officers who resides in Northern Sudan? Does it mean that
they are not needed by the leadership in South Sudan or by those
particular personalities? And finally whether if the leadership does
not want Southern Sudanese who were in Northern Sudan why started with
Agaar community moreover the Agaar community alone all over South
Sudan have never rebelled against SPLM/A and the current Government of
Southern Sudan under President General Salva Kiir Mayardit?

Sincerely speaking, the communities and the youth should be respected
by the leadership of SPLM and Government of Southern Sudan. We totally
deplore the arrest and the way our elder was humiliated and mocked by
“security personnel” at a time when the supremacy of the rule of law
suppose to prevail .This is so provocative and therefore can be
condemned by any reasonable person or community like us, within which
failure to accept our civil right to freedom of expression and
association is deliberate violation of our constitutional rights, and
perhaps may force us to take law and other measures into our hand
which is not of anybody interest at such critical movement.

 Recommendations

Following the youth meeting yesterday and after careful perusal and
discussion of the subject matter surrounding his arbitral detention;
the Agaar community youth members do hereby recommend and urge the
Government of Sothern Sudan to consider and quickly do the following

1. The youth and the Agaar community in general hereby request
the Government of Southern Sudan and the concern security organs to
immediately release uncle John Muorwel Majak Wol from arbitrary arrest
and possible torture as expected from the way he was manhandle. We
also demand the immediate release of a young man by name Thon Maker
Malok who was unlawfully thrown into jail for inquiring the
whereabouts of Muorwel Majak

2. That the youth of Agaar community is concern with social unity
of their people and if there are political leaders from within who
desires to divide our social force into political interest; then we
condemn such person (s) and call upon the Agaar community to desist
from such political malpractices.

3. The cloud of doubt that there are number of Southern Sudanese
who have assimilated themselves or formed militant groups including
John Muorwel Majak Wol and others is not true. The Lakes State
Community and Agaar community in particular had never and will not
accept such unfolded accusation from any interest groups elsewhere in
the Sudan and history is our witness.

4. That the Agaar community is the peace loving society in the
Sudan as a notable achievement was witnessed by the world when we
reconciled amongst ranks and files of SPLM/A in Rumbek, South Sudan
before the signing of the Comprehensive Peace Agreement CPA 2005
through which without famous Rumbek Meeting would not led to the
successful conclusion of Peace Accord between SPLM and NCP. Therefore
the current security forces that arrest people would not have existed
and might have derailed everything to square one not for the benefit
of any person.

5. In conclusion, we the Agaar community and the youth request
the release and the subsequent human treatment of our elders. We
request the Government at all levels to respect the interest of all
the Southern Sudanese Communities. We believe in the power of the
people and the Government that respects the rights and aspirations of
its people stays long. Sudanese. We strive to stay in peace and
harmony with other communities that make up the whole country. The
struggles continue!
