Written by Mading Ngor, The New Sudan Vision (NSV), newsudanvision.com Friday, 24 June 2011 08:40 (Juba NSV) - A sitting of the South Sudan Legislative Assembly on Wednesday adjourned over a proposed clause in the Transitional Constitution, which gives President the power to fire an elected governor during crisis.
The parliament debated whether the clause should be confirmed, amended, or rejected. Article 101 (r and s) of the Transitional Constitution of the Republic of South Sudan says the President shall “remove a state Governor and/or dissolve a state Legislative Assembly in the event of a crisis in the state that threatens national security and territorial integrity” and “appoint a state care-taker Governor who shall prepare for elections within sixty days in the state where the Governor has been removed or the state Legislative Assembly so dissolved in accordance with the provisions of this Constitution, the relevant state constitution and the law” respectively. The Committee tasked with finalizing the Transitional Constitution is headed by Hon. Dengtiel Ayuen Kur. On Thursday, Hon. Dengtiel told NewSudanVision.com in an interview at his office he was hopeful the spirited debate would be resolved amicably “by making a provision that was protective of the fears that were expressed by some of the members,” he said. Some MPs, including the Leader of the Opposition in parliament, argued against Presidential interference in States during crisis, saying complete autonomy for States was the true meaning of federal democracy. Others feared empowering the President to fire elected Governors may be abused overtime, pointing to the Nimeiri example. “We’re not going to satisfy everybody’s position, but where the majority goes, that’s the way democracy functions,” Dengtiel told NSV. “So we have to go by the will of the majority.” -- You received this message because you are subscribed to the Google Groups "JFD info" group.
