That is a shame.

I believe that the 4.01 spec is very clear on this point.

I have never used the validator, so I am not comfortable filing a bug
report. But if David (or someone else) wanted to file a bug then I would
certainly be interested in the results.

OK. I'll follow it up with the web community, file a bug if this is justified, and report back.
