- تنتشر تجارة (القرضِ بِرَهنٍ) في الولايات المتحدة،
حيث يرهن المقترض شيئاً من ممتلكاته الشخصية مقابل مبلغٍ من المال ، وله الخيار
بعد ذلك : إمّا أن يرُدّ المال
في الوقت المحدّد ولايدفع فائدةً ربويّةً ، أو أن يحتفظ بالمال فتنتقل ملكية
المتاع المرهون للتاجر المقرض، ولا يقوم التاجر
برفع تقريرٍسلبيّ عن إخفاق المدين لوكالات
التاريخ الائتمانيّ لأن القانون يحمي المدين من ذلك حيث أنّ الدّين مضمونٌ برهن،
والقانون-
كذلك- هو الذي يُحدّد سعر الفائدة ومدةّ القرض.
وهذه المعاملة
مباحة ٌ مادام الدّين خالٍ من الربا. A mortgaged
loan or (Pawn Shop) is a prevailing business in the US, where the borrower
offers mortgaging a property or jewlery against some money, so the lender can
secure his money. Then it is up to the borrower whether to pay back the money
on a set date with no interest, or he can keep the money while the mortgaged
property eventually goes to the lender. In case of the borrower's defaul, the
lender does not report
to any of the credit bureaus because the law protects the borrower against
that, given that the debt is guaranteed by the mortgaged property. Besides, it
is the law that fixes the duration of the loan.
Such a
transaction is permissible, as long as it is an interest-free one.
