Hah, I think my assessment wasn't wrong. I use xfwm4 instead of KWin (sorry
guys :)) and for once I ran it in a terminal.

When the update notifier came on, I saw this:

I think that proves that the panel does indeed sometimes override our user
preference for it NOT to be on top all the time.
