This is purely contemptuous and takes place despite our filing of contempt proceeding against the government. The court order was issued on 15th October 1997 and the government continues to embark on this dastard exercise ignoring the plight of the Ogiek community who live within the forest. We challenge the government to come out clearly and explain why these surveys are going on. The group doing the demarcation is led by a Mr Joseph Rono who says he was "employed by the government" to assist the surveyors. We have noted with great concern comments by the Elburgon DO who claims that this is a government project and is taking place within Nakuru District and that Marioshoni will not be an exception. The DO has warned us not to interfere with the program and threatened that we are playing around with bees. The government wants to force us into a settlement we have previously rejected and challenged in court. We challenged the settlement because: a.It disinherits our birthright -in that we were only getting a small portion of our ancestral land in East Mau Forest, while the rest was being dished to outsiders. b.The sub-division also interfer with our clan-based land tenure system where land is communally owned by seeking to introduce the western-styled individual owned system. c.The people who were being brought had their own homes elsewhere and were only getting additional land. We do believe that they are not landless. d.The government is trying to seek a political solution to our problem. Meanwhile, Kuresoi MP, James Koskei recently told a public meeting that Tinet and Kiptororo wards will be phased in the new electoral boundaries review. The said wards are inhabited by the Ogiek community and we will resist attempts to phase them out. We understand that Neisuit ward has been scrapped and we feel this is an attempt to reduce our voice within the local government. Jan. 2001 Demarcation and allocation of Land in East Mau forest has began. It was officially announced on Thursday 4th. Jan.2001 by Elburgon District Officer (D.O) who was accompanied by a team of surveyors and the Officer Commanding Police Station (Elburgon) Inspector Otundo. " This is purely a government project, which is legal, and anybody interfering with it will face the full force of the Law". said the D.O addressing a group of more than 300 Land Speculators from outside the district who had gathered in Mariashoni Chiefs office. Demarcation and allocation of Land in East Mau Forest was stopped by the High Court of Kenya following an application by the Ogiek community in Oct.15, 1997. The injunction was ordered till the matter is solved and determined by the court. The government has on different occasions been violating the court order by secretly allocating the land to powerful politicians and senior civil servants. "We are in process of demarcating the cutline in readiness of degazettement" said Ole Serian, Nakuru District Commissioner (DC) addressing the OWC officials on 3rd. Jan 2001 during a courtesy call to his office. The Kenya Government is violating the court order so as to intimidate the Ogiek and further weaken them in their struggle . The Ogiek are resisting the government efforts of alienating their ancestral lands, which for many years has been serving as a forest reserve. The Ogiek depend on their ancestral forests for bee-keeping and gathering of wild fruits and animals. The Government move to evict the Ogiek and subdivide the forest poses a very serious threat to the very existence of Kenya's Smallest Indigenous Tribe and also could lead to serious environmental disasters. Mau forest is the home of about 10,000 Ogiek indigenous peoples and a water catchments for major rivers and Lakes in the region.
