Not a fair comparison (God let's not have Yet-Another Copyright thread!)
since sculpture and chairs can't as easily be "copied", as works of art
can be.
Apparently, you've never actually *made* museum quality photographic[1]
art (I have). That is, you've never
o Calibrated the equipment (camera, meters, enlargers, chemicals, etc.),
o Calibrated the film,
o Taken the photograph,
o Processed the negative (using a consistently repeatable process),
o Made a print from the negative, and
o Processed the print (using a consistently repeatable process).
(I won't even count archival processing, or mounting or other
presentation steps).
It's no easier to faithfully a photograph (i.e. to the degree that the
copy has any practical economic value and is not seen as an obvious
fake) than it is a painting or a sculpture.
You trivialize the process of copying. Throwing a photograph on a Zerox
machine, copying a picture from the Internet, or even printing a
photograph from its original negative is not the same as copying the
photograph. Photographs, like sculptures and paintings are unique
creations. Even if I make ten copies of my own negatives, trying as hard
as I can to make them identical, I cannot.
(Hint: have you ever seen (let alone used) a grain magnifier?)
While forgery is not impossible for an adept in the craft or art,
forgery is not copying. Forgers are not prosecuted for the violation of
copyright law, or even theft; forgers are prosecuted for forgery.
I stand by my statement.
[And I find any serious discussion of copyright not only relevant to
Linux, but even vital. After all, without copyright law, Linux's GPL
would not be possible.]
[1] Because Gus used Ansel Adam's work as an example, it is implicit in
this discussion that we are talking about *silver halide* (or similar
processes) based photography, not digital photography.
