Definition: Having dominant market share does not  necessarily define a company 
as a monopoloy. The government looks at  monopolistic tendencies to gain market 
share or or maintain it.

Semantically, you're right in the usage you use above. What word would 
you use, given that a Federal Court's finding of fact that Microsoft is 
an effective monopoly in its market? One does not need a 100% market 
share to have a monopoly in that market.
