The 99% user-supplied CDDB DB was co-opted and made proprietary for very vague and fuzzy reasons years ago. Lots of ugliness, especially with Gracenote threatening to sue anyone+dog for using /their/ database. And now Gracenote is pretty much a dirty word in FOSS circles. A precursor to today's MAFIAA tactics.

I don't remember there being any real copyright infringement issues - mostly just greed and "We can do it and we will, so sod off!" by the Gracenote gang.
