I agree that themes should be an exception. I'd like to encourage brands to create their own instances (Red Cross, ESPN) and requiring that their theme be shared back to the community for anyone to use does seem like a point of contention, particularly when the theme involves their previously-trademarked logo.
BTW, Evan, I appreciate how diligent you've been about making sure new instances share their code back.
