You aren't presenting a clear picture of who is paying whom.  You pay
RoadRunner, but you haven't identified who the "hacker" pays.  If you
cause trouble for your ISP, they may kick you off.  Similarly for your
"hacker".  If the hacker's ISP doesn't care, you have to go up the chain
to the ISP's provider.  A traceroute to the hacker can tell you what IP
numbers the packets have to pass through, and you start sending emails to
the owners of those IP addresses.  It is best to resolve it as close as
possible to the hacker, because one troublemaker is probably not going to
cause a backbone provider to drop off an ISP, but the complaints add up.

If you both share the same ISP, I would hope you would have a better
chance of getting results, but you only have the threat of switching your
business to apply leverage with so you have to decide whether that is
practical.  In most cases the larger ISPs are deluged with these kind of
complaints, and it costs them money to cut service so they won't take that
step lightly.
