What a mess! I would probably use Cummings and then in the notes explain the use of the alternate name. I would put it in the AKAs as well.

I thought of putting the Surname in as Vien/Cummings or vice versa but legacy doesn't seem to like that. Also the brother Joseph is listed in Quebec census records as Vien until 1891 when he is listed as Cummings .. His children, at his death, then moved to Vermont and from then on used Cummings.
