That was precisely the reason why I dropped it. We took a new upstream version and I assumed their patching process was/is the same as the kernel's, i.e. no patch gets applied to a stable branch without first hitting master. Maybe that was a bad assumption on my part. I realised at the time that the fixes patch still applied, but again assumed that fixes may have been made in a different manner. I'll try to get a patch together that just fixes this problem, as no one's reported any other issues yet. I'll also ping upstream and see what's going on there. Looking at current git sources, the patch still hasn't been applied.
