I do not understand your thinking.  The prosecutor and a defense and a judge 
all represent different levels  of justice.
A judge is not supposed to be   involved in a prosecution nor in making a 
decision as to the punishment. He may at best ask for the hardest penalty, yet 
within the law.  
If a late abortion is considered a crime, then  it will be decided the same way 
as all  murders are. You must have a law no matter what is your ideology. 
Nevertheless, why  would you even suggest that a proper punishment in a 
libertarian society for commiting a murder could beor should be a death 
penalty? 
Do you support  death penalty?
