It is a federal constitutional issue. Article 1 Section 8 Clause 4: "Congress shall have power ... to establish an uniform rule of naturalization..." Article 1 Section 9 Clause 1 "The migration or importation of such persons as any of the States now existing shall think proper to admit, shall not be prohibited by the Congress prior to the year 1808 ..." As early as Washington's first administration, Congress otherwise limited immigration to free White males over 21. Congress banned importation of Blacks on January 1, 1808.
