*) you wiped "architectural" argument among copyright developpment from my 
answer : even lightnings on Eiffel Tower, which sits on the public place, are 
"copyrighted" (as the way copyright is written in French Law), and that apply 
even on photography/pictures of it.

Beside public space parasitism (depending on local law), copyright *is* the key 
point, as it is the only way to a gratis "protection" (while to sue will ever 
cost, even with patents).
