I've been experiencing visibility issues too. Jon told me that server-side list is mandatory to get correct (in)visibility. Did you checked this option? Anyway the use of server-side list didn't fix things to me, I got many mix/conflicts between my local contacts list and the server side one (server reports errors), but Jon is currently performing tests upon it. But that's another topic..
