I don't understand why this is the wrong thing to say. IMHO "based upon" is a decent statement - Unix came first, and Linux uses pretty much the same commands, the same general organization, ..., and it made to have essentially the same look and feel - isn't it? Now - if they had said "derived from", I'd feel differently.
