You are wrong. Read the GPL. Everyone who really knows it understands that your code comes under the GPL whenever you mix it with other GPL code. That is the way it works. The fact that it was distributed improperly, according to the license, makes it a violation of the license it is under. Otherwise there could be no violation, right. Think it through. There cannot be a violation unless the license is already in force.
