It might be better to find out what's causing the dialling in the first 
place, but you an restrict diald to stay down (or up, for that matter) 
by using the restrict directive in /etc/diald.conf.

e.g.

restrict 20:00:00 23:59:59 * * *
down
restrict * * * * *

Will restrict diald not to bring the line up between 8pm and 
midnight. If you want to specify more than one time period (ie past 
midnight) you have to use or-restrict. e.g. Our diald connection is 
forced down between 8pm and 6am with

restrict 23:00:00 23:59:59 * * *
or-restrict 00:00:00 05:55:00 * * *
down
restrict * * * * *

at the start of diald.conf. The last line is necessary to make diald 
behave in 'on-demand' mode for times outwith the restriction.

The trailing *'s mean something, but I can't remember what.
man diald will tell you more.
