Kernel 2.4.x should be able to see 40 GB .. No patch necessary.
I am beginning to suspect if the hardware vendor has taken you
for a ride, since neither Win nor Linux can see it !!!
Step 1: Take off the lid and see the model no and check the h/w
specs for that model.
Step 2: Normally, hdparm and fdisk should be able to see the
whole disk. Boot through your rescue floppy into rescue
mode and do:
fdisk /dev/hda ... see if the full thing is recognised,
and if there is any free space anywhere. There are good
many chances of non-contiguous partitioning, specially
with DOS fdisk on a large HDD.
Step 3: Crosscheck the figures of fdisk with hdparm -i. You had
posted it, IIRC, but I have deleted the mail. Both the
figures should tally.
Step 4: If there are holes in your hard disk between the parti-
tions, or space left at the end, you can do the things
you state below, otherwise, no point.

Only the last partition should be deleted if needed. If that is
the extended partition, you will lose all logical partitions on
it. If the "holes" are in between the partitions, we may delete
the middle ones ... /home, /usr immaterial ... depends upon the
place where they reside. Moving a logical partition will make
no difference, because physical space is occupied by primary
partitions and the extended partition only. All logical parti-
tions come under the extended.
