What does "incoming call" mean in this context? If you have an outgoing ppp
connection active at the time, the phone line will be in use, causing the
incoming dialer to get a busy signal long before Linux, mgetty, or pppd gets
involved. If you don't have an outgoing call active ... well, the patches
you already described that release the device back to mgetty should already
handle that, right?
