I fully agree with you. Implementation  of software buttons belongs in
user space. You might even chose different solutions for different
programs. 

Now is seems that we have the same confusion, as in the serial mouse
driver, where most Logitech mice uses Microsoft og Mouse Systems protocol.
It's just the old ones that uses the Logitech driver.

Now we have: Wacom Graphire and Wacom Intuos uses wacom.o and Wacom Pen
Partner uses hid.o. How many Wacom Pen Partner users will try to use
wacom.o and get no result ?

Actually we mostly have Wacon Inc. to blame....
We couldn't even have been more safe if we have kept the original graphire
and intous modules ?
