The rules for posts on the list, absolutely.  But I don't think I have the 
right to make rules about how my list subscribers must act when they send 
emails privately, not through my list.  In fact, I think they might have 
some cause of action against me if my list had commercial value and I kick 
them off for their behavior off the list, claiming that I'm infringing on 
their rights to free speech.  (Similar argument to why private clubs that 
were restricted to whites only, or men only, have been forced to open up 
their doors to those who were formerly prohibited, even though they are 
*private* clubs, because of the business activities that take place 
within.)  IANAL, so I could be completely wrong.  But I sure wouldn't want 
to be the test case to find out.
