  Thank you Judith for straightening poor little William out.  He needs
all the help he can get.  For that matter, so does Register.com.  I am sure
we can expect many more of these shenanigans from ICANN's #1
Registrar, Register.com.  It is a saga, worthy of a book!

True enough, there is a contract.

Problem is, Register.com's contract supports NSI's request to return the domain name:

Register.com, para 12, reiterates the Accreditation Language:

You further acknowledge and agree that your registration of a domain name is
subject to suspension, cancellation or transfer by any ICANN procedure, by any
registrar (including register.com) or registry administrator procedures approved by
an ICANN-adopted policy, or by any other ccTLD registry administrator procedures
as the case may be, (X) to correct mistakes by register.com, another registrar or
the registry administrator in administering the name or (Y) for the resolution of
disputes concerning the domain name.

Also according to the Wired article, the domain name is up for sale on an auction site for $500,000.  This auction site happens to have a marketing relationship with Register.com.  There is certainly the potential for the appearance of impropriety on the part of Register.com.

Actually, this one is laid right on NSI's plate.  It was clearly the fault of
NSI's inability to keep the SRS system up and running consistently.  There are
repeated reports of excessive down time with NSI's registry system, that is the
REAL cause of this issue.

Funnily enough, this also is NSI's fault, but this time of the REGISTRAR end.
They failed to take proper measures to protect this domain, by doing a legit
transfer, and instead deleted the domain name, and thus made it available.
There is no misdeed by Register.com here, and indeed, the fault rests squarely
on NSI's shoulders.  They were negligent, pure and simple.

So, anymore false representations in your little smear campaign, Jeffie?
