I believe that was in regard to accessibility? Unless I wasn't reading closely enough.
The HTML validator has a few bugs, but I think you are safe in this situation.
Unless I am mistaken, one of the only things you need to consider in cases like this is that you don't nest a block level element inside an inline element.
<li>'s are considered block level, no?
