As you are finding out, OOTB SharePoint for document oriented collaboration has some things that really annoy. Issue 1 is a major annoyance. While it is a list you are working with, there are a few ways to handle it, the best IMO being the work Clayton's colleague did.

But you are talking about document oriented collaboration and unfortunately when using any of those methods on a document library, the document info panel will not reflect this functionality, being infopath and all.
I'm sure I saw a commercial product by a Danish company that alleviated this also, but in checking my browsing history I can;t find it now. I came across it on MSDN newsgroups if thats any help... Maybe someone else knows the company I'm talking about
With option 2, what about using the list item attachment functionality? Getting data in to the list in a nice, bulk manner will not be OOTB however.
