Correct... however, until one is charged and the law proven to be invalid in a court or someone gets a legislature to realize the law is illegal, it stands and you can be tried for it... it might be repealed/overturned..but till it is, then you get to go to jail, get fingerprinted, meet some big guy named tyrone/carlos/bubba who thinks you are sweet and pay for legal fees.. its all a huge PIA... a local clerk in a court has no jurisdiction to change a law invalid or not..
I agree a law that is messed up needs to be overturned or repealed... however, what I said still holds true.. take the time to check out the state laws in any state that are in direct conflict with federal law that NO one has ever bothered to get repealed... no state is perfect... ya know , a city gets its ordinances run by a lawyer, in theory... is that lawyer in his interpretation right...not always... If you don't like a law and know its not right..then find an attorney who is willing to go for it pro bono.. a boater in stuart did.... and won...
