is suse 9.3 supposed to be duplicated and redistributed freely by
anyone? what does suse's license say? is this not illegal? how does
suse (and commercial distributors like Kym.net gain?)

This is what the license says:-
"The Software is a collective work of Novell. You may make and use
unlimited copies of the Software for Your distribution and use within
Your Organization. You may make and distribute unlimited copies of
the Software outside Your organization provided that: 1) You receive
no consideration; and, 2) you do not bundle or combine the Software
with another offering (e.g., software, hardware, or service)."
So as far as I can see, there is nothing illegal about distributing it for free.

in (1) above, does "consideration" mean "money" ? :-) (sorry, am not good at legal jargon)

Usually money, but not necessarily.
Consideration means something of value that is given in exchange for getting something from another person

PS: I didn't make it up. I googled and got it from this page:-
