The fact that you are asking these questions indicates that porting the source to a recent kernel isn't a viable option for you. Do you have budget to pay someone to do this? Porting an ancient kernel driver for a specific piece of hardware to a newer kernel is going to be one of the easier kernel coding tasks and shouldn't cost much.
