This is becouse LyX wants to be overly clever. There is an option to set the
math-font-size without ERT (see the user-manual) but this has 2 drawbacks:
There is no visual feedback at all :-(
(At least to me,) the scope of the command remains unclear.
Now, when reloading, LyX "renders" the \scriptstyle command by making it
invisible.
A workaround is to define your own replacement command in the preamble,
\newcommand{\uffe}{\scriptstyle}, say, so LyX is tricked out and leaves it as ERT.
