Hi,

as I've seen some on- and offlist discussion about WWDC 2008 and OOoD e.V. supporting Mac Porting in general, I'd like to write some words for clarification.

Uwe Altmann schrieb:
Concernig 2.) I have verbally promise for an overall donation of 2.000,00 EUR (written request is on the way) from OpenOffice.org Deutschland gem. e. V. in 2008. (This is not especially dedicated for WWDC but may also be used to do some refunding for developers participating on the planned 3rd Mac porting meeting.)

The funding request (including the information about this global call for funds) was formally sent to the board of OOo Deutschland e.V. 1.5 hrs before this mail to the mac porting list. Although the issue has been discussed beforehand, we (board members) were caught somewhat unprepared. There fore, the formal response to Uwe took some days.

After all we are happy to support Mac Porting and are ready to donate 2.000,- EUR for Mac porting. But as we have some legal obligations to fullfill we have set some conditions. (Not really troublesome - more on that later.)

Also, OOo D. e.V. is willing to coordinate donations for Mac Porting on their account. Important thing is that the money is explicitly dedicated to "MacPorting" - not more (no "travel money" or "For WWDC" or something else). So anybody has to write explicitly "For MacPorting" on the Money transfer form or we will not get it. German donators even can get a "Spendenbescheinigung" so they must not pay taxes on the amount donated.

This is correct - and for translation: OOo Deutschland e.V. is an accepted charity organization under German law. As such, we are bound to our charter, that states that we support "people's education by use of Open Source Software, esp. OpenOffice.org". There are some more points (e.g. furtherance of international collaboration) but important is, that we need to report every two years that we follow our charter (this is the report to the tax office - we need to report to our assoc. members every year).

For Mac Porting, this means that we have to use every donation that we receive for "MacPorting" for exactly this purpose : "Mac Porting". But the activities need to be in line with our charter. I think, it is not difficult for people, who now both - our charter and the activities of the mac porting project - to get both in line and find the correct words.

So, this is the condition we put on the funding: we would need some words, what the funds should be spent for (e.g. for what activities), how this is in line with our charter - and once, the activities are done - a report, what has been achieved. (This is no only due to legal restrictions - this is also to prevent misuse of the donations we receive.) In some cases, the board members can do this "internally" (as we are all involved in several parts of the community) and just need to have the reports ready for review. In case of Mac porting this is not so easy, as none of our board members is involved in Mac Porting. Therefore, we asked Uwe to handle this piece of "paperwork". But we did not receive an answer yet.

Ok - current situation is, that we have a 2000,- EUR budget for MacPorting - but this needs some more detailed activity plan, as stated above. We already received some donations dedicated to "MacPorting" (less than 100 EUR, but many many thanks for every donation). What we actually need is someone who takes the responsibility to use this donations in the sense of the mac porting project and in line with our charter.

Although this is getting lengthy, I'd like to add some other point, that Louis already mentioned:

You can request funds from Team OOo through the Community Council. Team OOo is also an association under German law, but no charity - so some of the legal restrictions do not apply to Team OOo and handling funds for the community is easier. We know, that handling of funds through CC was somewhat complicated in the past - but the council is working to geht the process closer to the community. (see http://council.openoffice.org/servlets/ReadMsg?list=discuss&msgNo=1439 and the council minutes / logs at the wiki)

best regards,

mit freundlichen Grüßen,

André Schnabel
