the permissions are set to match the permissions of the functioning scripts. I've noticed that when I use Fetch or Dreamweaver MX when uploading the file the file size says 0! Huh? I've tried refreshing the window of both programs and double checked the file size (40k).

Can't say. It's a text file and you're uploading it as text, correct? and not as binary or MacBinary, and you're uploading from another Mac running MacOS 9?
I'm uploading a standalone Mac cgi script (one of the options in MacPerl) from a machine running osX and Dreamweaver MX as well as uploading the script via Fetch running in classic mode. Perhaps I need to boot up in OS9 and upload the script? I'll try that.
Have you had any other cgis you've put on his server working?
