This check box is broken.
I've tried it, and it doesn't have any baring.

I've read some posts on list from people here who don't really want their
windows restored to the way they were, particularly in Safari. While I
don't know of a way to stop individual apps from acting this way, there is a
global preference to do so for all of them. The new General pane contains a
checkbox to prevent app window restoration.
