One of the things to consider, while there might be a lot of abusive spam sources using their networks, your success may depend on whether your segment is one of those that Hetzner allows/supplies SWIP/rwhois listings...

Generally this appears to depend on the data centres..

On this range, they seem to allow/give customers SWIP/rwhois listings..

Make sure that you get 'rwhois/SWIP' from them for your IP(s) and it might help your case.. This way you can point out while the IP(s) may be delegated by them as an upstream provider, you are taking responsibility for your portion of that network.
