According to MySQL, Germany: IF a commercial program (or to be more precise: a program NOT under GPL) is using a MaxDB database server, the user MUST have a commercial license for that database server.
This is also true for WWW services.
Or the other way round: if you have a program which uses a MaxDB (or MySQL) and you do not have a comercial license your program can be seen as GPL.
MySQL allows you to TEST your program against MaxDB without a commercial license.
