Seeing how the data directories are changing but I wonder if I could exclude the <independent_data> path but backup the rest and it be ok?

The backup software will only be able to capture each file a few chunks at a time so the file you start to backup won't really be the same by the time you finish (i.e. it's a moving target as you are backing it up).
