Copyright has both civil and criminal aspects. While AHRA provides immunity
from a civil lawsuit over home recording (and then only under certain
circumstances), it does not address its legality - see

Actually, it specifically falls under the AHRA (American Home Recording
Act) and generally under international copyright law.
