FCC Rejects XM's Solution on Compliance

NEW YORK - XM Satellite Radio Holdings Inc. said late Wednesday that the
Federal Communications Commission had rejected its solution for bringing
certain radio units into compliance with FCC standards.

XM had said in late May that it was suspending shipments of some radio
models, including the Delphi XM SKYFi2 and the Audiovox Xpress, after the
FCC found that the small FM transmitters the units have didn't meet the
FCC's emission standards.

The units are intended for use in cars, and allow satellite radio
subscribers to listen to XM's programming by beaming the signal to a car's
standard FM radio over a frequency that isn't being used by a regular
station.

XM has been working to fix the problem, but the company said in a regulatory
filing Wednesday that the FCC had rejected the company's testing results of
the new modifications. XM said it was still working to bring the models into
compliance with more testing and design changes.

Earlier this month Directed Electronics Inc. said it had received notice
that two Sirius Satellite Radio Inc. radios it markets were also found to be
out of compliance with FCC emission standards, the Sirius ST2 and Sirius
S50-C. Directed Electronics also said it was working to fix the problem.

In both cases, there were no health or safety issues with the radio units.
