Iatric Systems, Inc. Initiates a Civil Action Against Care Fusion,
Incorporated and Others for Copyright Infringement and Other Wrongful
Acts

BOXFORD, MASSACHUSETTS - Iatric Systems, Inc., a provider of innovative
software, interfaces and NPR services to hospitals and health systems
operating the Meditech(tm) Health Care Information System, and Kenneth
Hoffman, Vice President of Iatric Systems' Interface/Integration
Division, filed suit in Federal court today against Care Fusion,
Incorporated, and three Care Fusion employees, alleging copyright
infringement, breach of contract, misappropriation of trade secrets,
conversion, and unfair and deceptive acts or practices.
The suit accuses the defendants of copying Iatric Systems'
software known as "VBOT". VBOT, the subject of multiple Federal
copyright registrations, is proprietary code contained in many of Iatric
Systems' Meditech(tm) interface products. It permits hospitals to script
data into their Meditech(tm) databases without the need for manual input
or any additional wiring or hardware. The suit further accuses the
defendants of passing those illegal copies off as their own and
licensing them to at least eight hospitals located at various sites in
the United States. The suit seeks a temporary restraining order as well
as preliminary and permanent injunctive relief, damages, and attorneys'
fees and costs.
The suit was filed shortly after Mr. Hoffman, the author and
co-owner with Iatric Systems of VBOT, discovered the illegal copying
while performing routine support services to several of Iatric Systems'
licensee hospitals. The hospitals are not named as parties to the suit.
The Complaint was filed in the United States District Court for
the District of Massachusetts by the law firm of Morrison Mahoney LLP,
whose team is headed by Boston litigation partner and commercial and
business law practitioner Douglas B. Otto.
Care Fusion, based in Maclean, Virginia, provides point of care
solutions to hospitals.
Joel Berman, President of Iatric Systems, stated that "Iatric
Systems is shocked and disappointed that Care Fusion has chosen to
compete with us in this manner. We intend vigorously to defend our
copyrights and to protect the hours and hours of work that went into the
development of this unique tool. It is unfortunate that these hospitals
have been misled to believe that Care Fusion actually had its own
solution."
Iatric Systems and Mr. Hoffman have also notified the United
States Attorney's Office in Virginia of their concerns, requesting that
the Department of Justice launch a criminal investigation of Care
Fusion's conduct.
