Malicious prosecution with no intent to secure a conviction? That's virtually impossible to prove, even when it's true, and in this case I think they expected a conviction. Some states have laws attempting to shift the cost of prosecution onto the convicts. In order to be fair, those states should also shift the cost of a successful defense onto the prosecutors.
