Again, just file a return with ebay, unless you have screwed around with
the guy long enough to be outside the return window, or if the
auction/listing was non returnable for some reason.

That stinks, but it can and does work. FedEx has similar policies, and
when they packed and later crushed a Mac Pro in Apple factory packaging
that was sent to me, the buddy who sold it to me had to file the claim.
In my case the seller has dropped off the face of the earth ...
