        Which card is this?  A WinTV or similar Bt8x8 card?

        I saw mention of a HD5500 recently.

        There's a possibility that'll just  move your problems to a different 
        area.  Maybe not though. If editing/cutting to 1/2 second accuracy is
        sufficient then you can use ProjectX to do the editing.   For HD
        you'll need to do some additional processing of course ;)

        Back to the problem...

        Somewhere thru the path the data is taking 'ffmpeg' is being used
        to do encoding to MPEG-2 using the 9Mb/s.  That is a VERY high rate
        and leaves little headroom for spikes.  TO encode and that rate
        and not exceed the max allowed for DVD requires *VERY GOOD* rate
        control in the MPEG2 encoder.  

        mpeg2enc's rate control has been quite good but has become even 
        better in the CVS version. 

        ffmpeg's rate control had issues at one time, but I'd thought they'd
        been fixed.  Maybe there are some additional parameters that can
        be passed thru to ffmpeg to improve the rate control - I don't know
        what they are.

        Try using a lower rate - I'd try 8Mb/s and see if that works.  If not
        and if switching encoders isn't an option then I think you'll need to
        get on the ffmpeg-users mailing list.
