in most cases you will be correct with your assumption. But I cannot say for sure, that there isn't a case outside in reality, for which the tagging on crossing node is correct. So I'm not sure if ignoring would be helpful in every case.

Maybe it would be a better thing to generate for such osm-bugs gpx-files, which contains the bugs. So it would be easy to fix them.
