What's also difficult to explain is the list of M$ supporters (from the
same article): 

"...Google, Apple, Intel, Facebook and Yahoo filed amicus briefs in
support of Microsoft’s effort, joining the argument for lowering the
burden of proof. The Electronic Frontier Foundation, a non-profit legal
foundation that fights for consumer rights, also joined Microsoft’s
effort.."
