I've no real idea why eBay cares about the phrase "no rights
given or implied" but you're right that it's useless. It's a
phrase that's been around a long time, used as a magical
incantation by sellers of, first, bootleg prints, and, later,
illegal video tapes and now DVDs. It was to somehow give
the impression that these illegal sales were somehow
legitimate because the seller wasn't suggesting any
copyrights were being sold as part of the transaction. I still
see it on illegal DVDs being sold at various conventions and
such. It's true that the sale of the print/tape/DVD doesn't
convey any underlying rights to the purchaser. But it doesn't
make the creation/sale of the copy any more legal. That, in
and of itself, is a violation of the copyright holder's rights.
Perhaps in eBay's "infinite wisdom", the phrase is a tip off
that the item in question is illegal and therefore their
software looks for it. But if you take the phrase out, the item
somehow magically becomes legal.
