I agree with Tommy that some people might mistakenly hit the
"Reply" button rather than "Reply All" but I am really talking
about people who deliberately reply "Offlist" with private
comments. They often make very good and valid points and its a pity
that they dont want to post to everyone on the List.

I suspect part of the problem is that when you click on 'reply' it
addresses the response to only the original sender by default, and
you have to scroll down to send to all the subscribers. Might be
better if that could be reversed.
