You seem to be making a problem here of something that isn't one.
First, from the moment where this is not public domain, yes, you need a
licence to use it, that can not be avoided, just like I need a licence
to use NSS. If I agree to comply neither with the MPL nor with the GPL,
I'm not granted a licence and I can't use NSS.
The clumsy part is that you need to fill the licence, sign it and send
it to Entrust. But when we talk about the licence for a patent, this is
in fact a useful protection. Without it, there's nothing that
materialize receiving the licence, and when you got it.
May I bring your attention to the Unisys/GIF case, where Unisys
repeatedly changed the rule of the game and began charging people in
situations where they initially said it would be free of charge ? If
there had been a way to prove they had received a licence under the
initial terms, Unisys would not have been able to arbitrarily apply them
the new conditions.
